Patrick Thompson is an accomplished litigator with a corporate commercial practice focused on construction litigation. He has extensive experience in complex, multifaceted claims requiring exceptional legal and management skills. Patrick acts for local, national and international clients, including owners and developers, general contractors, subcontractors, suppliers, architects, engineers, designers and planners.

Experienced in all manner of construction disputes, Patrick acts for clients in lien claims, and claims relating to extras, delay and acceleration, negligence, and breach of trust. He assists stakeholders in public-private partnerships (P3s) and parties to engineering-procurement-construction contracts, resolving disputes over construction delays, increased costs due to changes in site condition and changes in design.

Patrick has appeared at various levels of court and arbitral tribunals in many Canadian provinces and practices in both official languages.

Construction Matters

  • Acted for one of two consortium partners engaged in a complex three party construction arbitration relating to the design, supply, installation, and commissioning of four synchronous condensers located in northern Manitoba;
  • Acted for a federal government department with respect to a delay and cost overrun claim for the renovation, rehabilitation and restoration of one of Canada’s most iconic heritage building;
  • Defended a delay and cost overrun claim in respect of the rehabilitation and renovation of a historic building in Ottawa’s Byward Market;
  • Defended a truss component designer from a series of complex, multi-party design defect and negligence claims;
  • Represented a multinational technology company in a building envelope defect claim;
  • Represented an international agribusiness and food company in a dispute with an international contractor providing energy reduction services at sites internationally;
  • Represented the second-largest social housing provider in Ontario with respect to a construction defect dispute;
  • Represented an industry leader in strategic commercial roofing system solutions from a series of complex negligence claims;

Commercial Matters

  • Represent Canada’s largest and longest-standing equipment financing company in the enforcement of their leases;
  • Represent a global sustainable energy company with respect to their civil claims at retail outlets across Canada;
  • Represented a multinational retail corporation in the enforcement of their commercial lease rights;
  • Represented one of Canada’s largest retail cannabis company with respect to a commercial lease dispute;
  • Represented a global logistics company in relation to a claim by a consignee for improper delivery of goods;
  • Represented multiple consulting companies with respect to the enforcement of payment terms of their subconsultant agreement for a federal government services contract;
  • Represented the shareholders of a single purpose entity who sought a wind up order as a result of its corporate purpose being exhausted;
  • Represented a global clothing manufacturer in a dispute related to a commercial real estate transaction for their Canadian headquarters and distribution plant;
  • Represented a metal recycling, manufacturing, and environmental services company in a pricing dispute arbitration for an exclusive long-term supply agreement;
  • Represented a developer in a Condominium Act Arbitration;
  • Represented a global communications infrastructure company in an indemnity claim against one of Canada’s leading telecommunication company;
  • Represented a privately-owned, infection control products manufacturer in a dispute regarding the production, supply and distribution of products into the United States;
  • Represented a promotional marketing company and its Canadian shareholders with respect to the enforcement of a merger agreement with a US corporate entity;
  • Acted to enforce and protect rights under the Expropriation Act;

Other

  • Successfully completed a two-year negotiation where our client donated 3 Ottawa area hospitals on 31 acres of land. The donation required multiple levels of approval, including from the Vatican and the Ontario Ministry of Health;
  • Successfully convinced the Provincial Crown to withdraw Occupational Health and Safety charges against a client without any plea agreement, penalty or fine;
