On January 25, 2016, McMillan filed a judicial review application on behalf of B.C. mining company China Minerals Mining Corp. (TSX-V:CMV) and its subsidiary, Cassiar Gold Corp., who allege the provincial government unfairly and improperly transferred ownership of the land under which the companies hold mineral rights. The transfer occurred pursuant to an “Interim Treaty Agreement” with a First Nation that contemplates another (incompatible) use of the lands. The petition alleges Cassiar was not consulted before the ITA was signed and its interests have not been fairly considered or compensated. The case raises important questions about the duties government’s owe third parties when making agreements with indigenous groups.
