McMillan defended Sjór AS, a supplier of Norwegian seafood, against a complex proposed class action alleging a global price fixing conspiracy with cross-border elements.

The claims, initiated in the Federal Court of Canada, alleged price fixing of farmed Atlantic Salmon and products derived from Atlantic Salmon through the alleged manipulation of pricing indices used in the Salmon market in North America and elsewhere. The complainants sought over $1 billion in general damages and $100 million in punitive damages. Similar class actions concerning the same alleged conduct have also been initiated in the United States.

David Kent and Samantha Gordon co-led McMillan’s success and, along with Guneev Bhinder, skillfully aided in the settlement of the entire action, which was approved by the Federal Court in February 2024.
