McMillan successfully represented Gibraltar Mines in the final offer arbitration before the arbitrator appointed by the Canadian Transportation Agency (CTA) against Canadian National Railway Company (CN) for rates and conditions of service in respect of copper concentrate shipments to export position.  We secured significant rate reductions and concrete service standards for shipments originating at Canada’s second largest open pit copper mine.

We also successfully opposed CN’s judicial review application in the Federal Court of Canada in respect of the final offer arbitration award. The Federal Court decision addresses, for the first time, the extent of the substantive assistance an arbitrator can request from the Canadian Transportation Agency.

Gibraltar copper-molybdenum mine, located in south-central British Columbia, is the second largest open pit copper mine in Canada and the largest employer in the Cariboo region. Taseko’s is the owner (75%) and operator of Gibraltar.
