Canada Infrastructure Bank Commits $25 Million to Modern Niagara’s Large Scale Commercial Retrofit

McMillan LLP acted as counsel to the Canada Infrastructure Bank (“CIB”) on its financing to the Modern Niagara Group (“Modern Niagara”), as part of the Building Retrofits Initiative (BRI). The CIB is committing $25 million in project financing for Modern Niagara’s energy efficiency retrofit project to achieve decarbonisation and modernization of, and reduce energy consumption and greenhouse gas emissions at a 220,000 square-foot commercial building in Kingston, Ontario. Modern Niagara intends to update the building to create an environment for discovery and innovation that serves all sectors (including environment, energy solutions, manufacturing, water management, and renewable energy).

The McMillan team, led by Ahsan Mirza and Alex Ricchetti, working alongside Julie Han, Shahram Khalili, Meagan Moulton and Samantha Irving, advised the CIB on all aspects of this complex project financing including leading the drafting of the credit and loan documentation, structuring the intercreditor arrangements with another major institutional lender, and drafting and negotiating the lender security including real property security.
